Terms and Conditions for The Swell Inc.Inc.
  1. Definitions
  • “Carrier” or “Owner” refers to the operator of the vessel.
  • “Passenger” refers to any individual traveling on the vessel.
  • “Ticket” refers to the contract of carriage issued by the Carrier.
  1. Contract of Carriage
By purchasing or using a Ticket, the Passenger agrees to be bound by these Terms and Conditions, which constitute a legally binding contract under the laws of the Province of Ontario and Canada.
  1. Governing Law and Regulatory Compliance
This service operates in accordance with applicable Canadian maritime laws and regulations, including:
  • The Canada Shipping Act, 2001
  • Regulations enforced by Transport Canada
  • Applicable public health and safety laws of Ontario
Any disputes shall be governed by the laws of Ontario and the federal laws of Canada applicable therein.
  1. Boarding Requirements
  • Passengers must arrive at least 15 minutes prior to scheduled departure.
  • Government-issued identification may be required.
  • The Carrier reserves the right to refuse boarding for safety, security, intoxication, or regulatory reasons.
  1. Fares and Payments
  • All fares are listed in Canadian dollars (CAD) and are subject to applicable taxes unless otherwise stated.
  • Tickets are non-transferable unless authorized by the Carrier.
  • Refunds are subject to the cancellation policy outlined below.
  1. Schedule, Delays, and Cancellations
  • Schedules are subject to change due to weather, water conditions, mechanical issues, or directions from port authorities or regulatory agencies.
  • The Carrier is not liable for delays beyond its reasonable control.
  • In the event of cancellation by the Carrier, passengers will be offered rebooking or a refund.
  1. Passenger Conduct
Passengers must:
  • Follow all instructions from the vessel’s master and crew.
  • Comply with all safety procedures and posted signage.
  • Refrain from unsafe, disruptive, or unlawful behavior.
The Carrier reserves the right to remove or refuse service to any Passenger without refund if their conduct poses a risk.
  1. Safety and Security
  • Passengers must comply with all safety announcements and emergency procedures.
  • Safety equipment must not be tampered with except in an emergency.
  • The vessel operates under strict safety standards as required by Transport Canada.
  1. Food and Beverage Policy
  • The consumption of food and beverages onboard is limited to items sold or provided by the Owner.
  • Outside food and beverages, including alcohol, are strictly prohibited unless explicitly authorized in writing by the Carrier.
  • The Owner may offer food and alcoholic beverages in compliance with applicable Ontario laws and licensing requirements, including those governed by the Alcohol and Gaming Commission of Ontario (AGCO).
  1. Alcohol Consumption
  • Alcohol may only be consumed if purchased directly from the Owner onboard.
  • Passengers must be of legal drinking age in Ontario (19 years or older) and may be required to present valid identification.
  • The Carrier reserves the right to refuse the sale or service of alcohol to any Passenger, including in cases of intoxication.
  • Intoxicated passengers may be denied boarding or removed from the vessel without refund if they pose a safety risk.
  1. Baggage Policy
  • Passengers may bring reasonable personal baggage, subject to space and safety limitations.
  • Hazardous materials, illegal items, and prohibited goods are not allowed onboard.
  • The Carrier is not responsible for loss or damage to personal belongings except where required by law.
  1. Liability
  • The Carrier’s liability is limited in accordance with applicable Canadian maritime law, including the Marine Liability Act (Canada).
  • The Carrier is not liable for loss, injury, or delay caused by:
    • Weather or natural events
    • Acts of third parties
    • Passenger negligence or failure to follow instructions
  1. Medical Fitness
Passengers must ensure they are medically fit for travel. The Carrier may refuse boarding to anyone whose condition poses a risk to themselves, others, or the safe operation of the vessel.
  1. Accessibility
The Carrier will make reasonable efforts to accommodate passengers with disabilities in accordance with applicable accessibility laws, including the Accessibility for Ontarians with Disabilities Act, 2005 (AODA). Advance notice is recommended.
  1. Children and Minors
  • Passengers under the age of 16 must be accompanied by a responsible adult unless otherwise authorized.
  • Adults are responsible for supervising minors at all times.
  1. Pets and Service Animals
  • Pets are permitted only with prior approval and must be properly restrained.
  • Service animals are permitted in accordance with Canadian law.
  1. Privacy
Passenger information is collected and used in accordance with applicable Canadian privacy laws and will only be used for operational, safety, and legal purposes.
  1. Amendments
The Carrier reserves the right to amend these Terms and Conditions at any time. Updated versions will be made available through official channels.
